Concord Management and Consulting LCC, she made a ruling in favor of the plaintiff, which was one of the 16 Russian companies indicted with a criminal charge by the Special Counsel Robert Mueller, when it wanted to dismiss the indictment, arguing Mueller’s appointment to his post was in violation of the constitution’s power separation. In a lengthy ruling she ruled that even though “no statute explicitly authorizes the Acting Attorney General to make the appointment, Supreme Court and D.C. Circuit precedent make clear that the Acting Attorney General has the necessary statutory authority,” “the appointment is not in violation of core separation of powers principles of separation of power. In addition, the Special Counsel has not overstepped his authority under the appointment order in the course of conducting an investigation the case and also prosecution of Concord.”
